Work Comp Policy

Internet Language:

Thousands of Kentuckians suffer workplace injuries every year. Fortunately, Kentucky’s workers’ compensation statute offers the majority of these workers with insurance that covers their workplace injuries regardless of fault. Almost all Kentucky employers are required to carry workers’ compensation insurance that provides benefits to injured workers including:

  • Medical expenses coverage;

  • Payment for lost wages (Payments are usually two-thirds of your average weekly wage);

  • Vocational rehabilitation services;

  • Payments for injuries that result in permanent impairment under the 5th Edition of the AMA Guides; and

  • Death benefits if a family member died from a workplace incident

There are many factors that can impact the value of your claim. A worker’s average weekly wage, age, level of education, impairment rating, and ability to return to work may all play a role in what you are awarded by an Administrative Law Judge (ALJ) or in a workers’ compensation case settlement.

Although, an injured worker has the right to file their own claim with the Kentucky Department of Workers’ Claims (DWC), but the process can be confusing and complicated. One of our workers’ compensation attorney’s can help you navigate the claims process and fight to get you the benefits that you rightfully deserve.

What should I do if I suffered a workplace injury?

First, you should notify your employer that you’ve been injured. It is important that you or a loved one report your injury to your employer as soon as possible.

Next, seek medical treatment for your injury and notify your doctor that you suffered a workplace injury. The doctor will provide you with an “off work note” to give your employer if the doctor says you need to stay home.
